1. Agreement and Eligibility

These Terms govern fixed-term hashrate rental services provided by Karpuz Mining (“Karpuz,” “we,” “us,” or “our”). By checking the acceptance box or placing an order, you agree to these Terms and the order details shown at checkout. You must be at least 18, legally able to contract, authorized to use the payment method and wallet provided, and located where the Service is lawful. You may not use the Service for fraud, money laundering, sanctions evasion, or other unlawful activity. We may refuse or suspend service for legal, security, fraud, or payment-compliance reasons.

2. Service

You purchase computational hashing capacity for the algorithm, nominal hashrate, and fixed term stated in your order (the “Service”). You do not purchase mining equipment, cryptocurrency, an investment, or any ownership interest. Service starts when we provision and direct the purchased capacity as ordered. Nominal hashrate is measured over a reasonable interval and may fluctuate because of latency, rejected or stale shares, maintenance, pool measurement methods, and normal technical variance.

3. Mining Risk; No Guarantees

Mining results depend on probability and factors outside our control, including network difficulty and hashrate, block times, pool rules and uptime, rejected or orphaned blocks, protocol changes, forks, attacks, reward schedules, market prices, fees, equipment conditions, laws, and taxes. Historical results, calculators, estimates, dashboards, and examples are illustrative only.

WE DO NOT GUARANTEE ANY REWARD, BLOCK, PAYOUT, REVENUE, PROFIT, RETURN, BREAK-EVEN, CRYPTOCURRENCY VALUE, POOL PERFORMANCE, OR UNINTERRUPTED SERVICE. A LOW OR ZERO REWARD, LOSS OF VALUE, INCREASED DIFFICULTY, OR FAILURE TO FIND A BLOCK IS NOT A FAILURE TO PROVIDE THE SERVICE.

4. Wallets, Pools, and Customer Instructions

You are responsible for verifying wallet addresses, networks, pool endpoints, worker credentials, and other instructions. Blockchain transfers are generally irreversible. We are not responsible for losses caused by incorrect, incompatible, inaccessible, compromised, or unsupported instructions, wallets, networks, or pools. Third-party pools control their own calculations, fees, thresholds, availability, and payouts, and their terms may also apply.

5. Payment and Taxes

You authorize Karpuz and its payment processors to charge the total displayed at checkout. Prices and material fees will be shown before payment. You are responsible for applicable taxes and reporting obligations, except taxes on our net income.

6. Final Sale; Refunds

Because Karpuz reserves and provisions time-sensitive computing capacity, each order is final and non-cancellable once Service begins. No refund or credit is owed because mining results are disappointing, no reward is earned, cryptocurrency loses value, difficulty or pool performance changes, or you change your mind.

If reliable records show that Karpuz materially failed to provide a measurable portion of the purchased Service, contact karpuzmining@gmail.com promptly with your order number and supporting details. Our remedy, at our option, will be re-performance, a service extension, account credit, or a pro rata refund for the unprovided portion. This policy does not limit rights or remedies that cannot legally be waived.

7. Chargebacks and Payment Disputes

If you believe a charge was unauthorized or Service was materially not provided, contact karpuzmining@gmail.com first when practicable so we can investigate. Mining variance, lack of rewards, lack of profitability, price changes, and buyer’s remorse are not valid contractual grounds for a refund.

If you initiate a chargeback or payment dispute, you authorize us to provide the card issuer, processor, card network, fraud-prevention providers, and advisers with relevant evidence, including your acceptance of these Terms, payment authorization, order details, communications, service telemetry, pool or worker records, and payout records. We may suspend related or future Service while a payment is reversed or disputed and may pursue amounts finally determined to be due. Nothing here waives a good-faith billing-error or unauthorized-transaction right provided by law.

8. Interruptions and Changes

We may perform maintenance and make reasonable technical substitutions that do not materially reduce the purchased Service. We are not liable for delay or failure caused by events beyond our reasonable control, including utility, internet, data-center, pool, network, protocol, cyberattack, government, sanctions, disaster, or widespread payment-system events. If such an event prevents a material portion of Service for an extended period, we may extend or substitute the Service or provide a pro rata credit or refund for the unprovided portion.

9. Disclaimers and Liability Limit

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” KARPUZ DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, RESULTS, PROFITABILITY, AVAILABILITY, AND SECURITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARPUZ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, OPPORTUNITY, DATA, OR ANTICIPATED REWARDS; MARKET LOSSES; OR THIRD-PARTY POOL, WALLET, NETWORK, OR PAYMENT-PROVIDER FAILURES. KARPUZ’S TOTAL LIABILITY ARISING FROM AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

These limits do not apply to liability or consumer remedies that applicable law does not allow to be excluded or limited.

10. Disputes; Florida Law

Before filing a claim, email karpuzmining@gmail.com with your name, order number, facts, and requested resolution and allow 30 days for an individual good-faith resolution attempt. Except for eligible small-claims matters or urgent injunctive relief, disputes arising from these Terms or the Service will be resolved by binding individual arbitration under the Federal Arbitration Act and the American Arbitration Association’s applicable Consumer Arbitration Rules. Arbitration may occur remotely. Fees will be allocated under those rules and applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMS MAY BE BROUGHT ONLY INDIVIDUALLY, NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION. IF A CLAIM PROCEEDS IN COURT, EACH PARTY WAIVES A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You may opt out of arbitration and the class waiver by emailing an individually signed notice to karpuzmining@gmail.com within 30 days after first accepting these Terms. Include your name, account email, and order number and state that you opt out of arbitration. These Terms are governed by Florida law, without depriving consumers of non-waivable protections in their home jurisdiction.

11. Changes and General Terms

We may update these Terms prospectively. Material changes apply to new orders after acceptance unless law requires otherwise. These Terms and your order are the entire agreement regarding the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. Electronic acceptance and records are permitted.
